I, HHHH of Post Office Box Number XXXX, Nairobi in the Republic of Kenya make oath and state as follows :-

1.            THAT I am an advocate of this Honourable Court practising as such  in the firm of WANJIKU and Company Advocates who have the conduct of this Suit on behalf of the  Defendant.

2.           THAT on the 28^th day of February 2000, the firm took out Third Party Proceedings in this matter wherein, the Court granted the orders sought and ordered service of a Third Party Notice upon the Third Party herein D. T. Dobie & Company (K) Limited. 

3.      THAT in order to set down this case for hearing it is necessary that directions be given as regards the question of liability between the Defendant as against the third party.

4.     THAT I swear this affidavit in support of the Defendant's application that this Honourable Court do give directions on the third party notice herein.

5.           THAT what is deponed on herein is true to the best of my knowledge, information and belief.
