The Penal Code of Tanzania does not define the term insanity. But reading carefully Section 13 of Penal Code, one may say the Code refers to the term insanity as any disease affecting a person’s mind as to be incapable of understanding what he is doing or of knowing that he ought not to do the act or make the omission constituting the offence.
