Where the prosecutor/complainant does not appear on the hearing of Criminal case the Court shall under Section 222 of the Criminal Procedure act do the following: (I) Dismiss the charge and acquit accused person; or (II). If it deems fit to adjourn the case for another hearing date and may release accused on bail or remand him in prison or take such other security for appearance.
What happens if a plaintiff does not appear on the hearing date?
Where the Plaintiff does not appear on the hearing date the Court shall under Order IX, Rule 8 dismiss the suit for want of prosecution.
