What is the concept of equality before the law?





The concept of equality before the law includes the following: 

(1) that Penal Law should not be retrospective e.g. The Economic Sabotages Special Provision Act, 1983. 

(2). Presumption of innocence for all. Law should be well known in advance. Rules should be made clear for everybody to know 

(3). Public officers should be liable same way as ordinary people. 

(4). Statutes should ensure justice. If law does not accord justice, then there is no Rule of Law.

The concept of equality before the Law means according to the professor Dicey equal subjection of all classes to the ordinary law of the land administered by the ordinary law Courts. That is, officials or other people are not exempted from the duty of obedience to the Law which governs other citizens nor are they exempted from jurisdiction of the ordinary tribunal.
