R. v. Mrisho s/o Seffu, Crim. Rev. 10-M-68, 15/2/68, Mustafa J.
Accused was convicted by a District Magistrate of the offence of incest by males. [P.C. s. 158(1).]
Held : This offence is triable only by the High Court. [Crim. Proc. Code, First Schedule.] Therefore, the trial was a nullity. Conviction quashed and case remitted to the subordinate court for a preliminary inquiry at the option of the Republic.
