The difference between Granted Right of Occupancy and Derivative right of occupancy?



The difference between the two is provided in section 2 of The Land Act No. 4/1999. Granted Right of Occupancy is the Right of Occupancy granted under and in accordance with the Land Act No. 4/1999 sections 27 -30; while, 

Derivative Right of Occupancy means a right to occupy and use land created out of Right of Occupancy and includes a lease, sublease, license, a Usufructuary right, and any interest analogous to those interests. 

Note thus; Derivative Right of Occupancy is created out Right of 

Occupancy i.e. there can not be a derivative right of occupancy in absence of Granted Right of Occupancy.
