What is alternative verdict?



Alternative Verdict is a verdict of not guilty of the offence actually charged, but guilt of some lesser offence not specifically charged. Alternative verdict is only permitted where there is insufficient evidence to establish more serious offence but the evidence given is sufficient to prove a lesser offence. It is governed by section 305 of Criminal Procedure Act and it arises where is charged with offence under sections 294 – 298 of the Penal Code but, is not found guilty with offence charged but that he is guilty with any other offence under the said sections.
