Where one of the Defendants does not appear on the hearing date, Order IX, Rule 11 of the Civil Procedure Code requires the Court to proceed with the suit. The rule also requires the court at the same time of pronouncing judgment, to make such order against the defendant who has failed to appear as it deems fit.
