Doli incapax means incapable of crime. Note: Under Section 15(1) of the Penal Code as amended by SOSPA the person under the age of 10 years can not be found guilty of any offences, thus this is the conclusive presumption. Under sub section 2 of the same Section, a person under the age of 12 years are presumed to be doli incapax; but the presumption may be rebutted where at the same time of doing the act or making the omission the under 12 years had capacity to know that he ought not to do the act or make the omission.
