Functus officio, Garnishee, ipso facto, Ejusdem generis, Consensus ad idem, Flagrante delicto





(1). Functus officio 

Functus officio means having discharged his duty, thus in matters of judicial proceedings once a decision has been reached and made known to the parties, the adjudicating Tribunal/Court thereby becomes Functus officio. 

(2). Garnishee 

Garnishee is a debtor in whose hands a debt has been attached. He is warned by the Court to pay the debt to 3rd party rather than to his creditor. 

(3) ipso facto 

Ipso Facto is a Latin word meaning by the mere fact.

(4). Ejusdem generis

Ejusdem generis simply means of the “same kind or nature”. It is the rule that where particular words are followed by general word, the general words are limited to the same kind as the particular words. 

(5). Consensus ad idem 

Consensus ad idem means an agreement as to same thing. It the agreement by contracting parties to identical terms, that is necessary for the formation of a legally binding contract.

(6) Flagrante delicto 

Fragrant delicto simply means the commission of an offence. The phrase is most commonly applied to the situation in which a person finds his or her spouse in the act of committing adultery.
